CLARIFICATION TEXT UNDER THE PERSONAL DATA PROTECTION LAW

As Kocaeli University of Health and Technology Faculty of Dentistry Oral and Dental Health Center (“Kocaeli University of Health and Technology”), as the Data Controller, this clarification text (“Clarification Text”) has been prepared in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”), the Regulation on Personal Health Data, the Communique on Procedures and Principles to Fulfill the Obligation of Disclosure, and related regulations, for the purpose of informing you about the collection, processing, and transfer of your personal data.

Your personal data, including sensitive health data, general personal data, and special categories of data, can be processed and transferred by Kocaeli University of Health and Technology Faculty of Dentistry Oral and Dental Health Center within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK Law.

Detailed information about the personal data collected, processed, and transferred can be accessed through the Personal Data Protection Board’s Data Controllers Registry Information System (“VERBIS”).

You can access the VERBIS registration of Kocaeli University of Health and Technology Faculty of Dentistry Oral and Dental Health Center by searching “Kocaeli University of Health and Technology” in the “Registry Inquiry” section at https://verbis.kvkk.gov.tr.

Method and Legal Basis for Collection of Your Personal Data:

Our hospital collects personal data through direct means during diagnosis and treatment processes, or via hand delivery, mail, cargo, electronic, printed forms, security cameras, and call centers, using manual, digital, automated, semi-automated, or integration methods. These personal data are collected to provide healthcare services and fulfill the legal obligations specified in the “Purpose of Processing Personal Data” section. Additionally, they may be processed and transferred within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK Law.

Purposes for Processing Your Personal Data:

The processing of personal data is carried out in compliance with the principles of lawfulness, accuracy, and up-to-dateness as defined under Article 4 of the KVKK, ensuring that the data is processed for specific, clear, and legitimate purposes, and that it is relevant, limited, and proportional to the purposes for which it is processed.

Your personal data is processed in accordance with the following purposes:

• Fulfillment of legal and regulatory requirements,
• Enabling patients to benefit from our hospital’s services,
• Protection of public health, and providing diagnosis and treatment services,
• Sharing necessary information with the Ministry of Health (e-Nabız) and relevant institutions,
• Managing the financing and payment processes of healthcare services,
• Conducting patient services and satisfaction analysis,
• Fulfillment of legal obligations,
• Managing emergency response and patient safety processes.

Who Can Your Personal Data Be Shared With and for What Purposes:

Your personal data may be shared by Kocaeli University of Health and Technology Faculty of Dentistry Oral and Dental Health Center with the Ministry of Health, SGK, private insurance companies, authorized public institutions, and healthcare service providers within the necessary limits and in accordance with relevant regulations.

Rights of the Data Subject Under Article 11 of the KVKK:

As data subjects, you may submit your requests regarding your rights in writing or electronically. Applications will be answered as soon as possible, and no later than thirty days, free of charge.

As a data subject, you have the right to:

• Learn whether your personal data is being processed,
• Request information if your data has been processed,
• Learn the purpose of processing and whether your data is used in accordance with that purpose,
• Request correction if the data is incomplete or inaccurate,
• Request deletion or destruction if the data has been processed unlawfully,
• Object if there is an adverse outcome based on automatic processing,
• Request compensation for damages caused by the unlawful processing of personal data.

You can submit your applications in writing to the address: Kadıköy, Turan Güneş Cd. No:204/1 İzmit/Kocaeli, by notarized mail or by sending an electronically signed application to the relevant email address.
